Scope & Acceptance

These Terms of Use govern your access to and use of any application, website, or digital service (collectively, the "Service") developed and operated by Hakiware, an independent software studio registered in Morocco under ICE number 003673187000049, with its registered office in Tangier, Morocco.

By downloading, accessing, or using any of our Services you agree to be bound by these Terms. Please read them carefully before using any Service. If you do not agree with any part of these Terms, you must not use the Service.

Eligibility

To use our Services you must:

• Be at least 18 years old, or the age of legal majority in your jurisdiction.
• Provide accurate, complete, and up-to-date information when registering for an account.
• Have the legal capacity to enter into binding contracts.
• Not be prohibited from using our Services under any applicable law.

By using a Service you confirm that you meet these eligibility requirements. If you do not qualify, you must not use the Service.

Intellectual Property & Restrictions

All intellectual property rights in our Services — including but not limited to source code, design, graphics, trademarks, database rights, and content — remain the exclusive property of Hakiware or its licensors.

You may not, without prior written authorisation:

• Copy, modify, adapt, translate, or create derivative works of any Service or any part thereof.
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of any Service.
• Redistribute, sublicense, sell, rent, or otherwise transfer any rights in a Service.
• Remove or obscure any proprietary notices, labels, or branding from the Service.

User Accounts

Certain Services require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at contact@hakiware.com if you suspect unauthorised use.

For professional or technician accounts, we may request identity verification documents and optional professional certificates. You warrant that any documents provided are genuine and belong to you.

The way we collect, use, store, and protect personal data in connection with your account is described in our Privacy Policy, which forms part of the information applicable to your use of the Services.

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

• Use any Service in a way that violates applicable local, national, or international law or regulation.
• Transmit unsolicited or unauthorised advertising or promotional material.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorised access to any part of a Service or its related systems.
• Transmit any harmful, offensive, fraudulent, or abusive content.
• Interfere with or disrupt the integrity or performance of any Service.
• Jailbreak, root, or otherwise tamper with your device in ways that could compromise the security of the Service.

Freemium Model & Pricing

Some of our Services are offered under a freemium model — a base tier is available at no charge, with optional paid features or subscriptions. We reserve the right to introduce, modify, or discontinue pricing for any feature or tier at any time.

Any applicable charges will be clearly communicated to you before a purchase is required. Continued use of a paid feature after a price change has been notified constitutes your acceptance of the new pricing.

Connectivity & Network Charges

Certain features require an active Internet connection (Wi-Fi or mobile data). Hakiware is not responsible for the Service not functioning fully due to lack of Internet access or exhaustion of your data allowance.

If you use a Service outside a Wi-Fi zone, your mobile carrier's terms apply and you may incur data or roaming charges. By using the Service you accept responsibility for any such charges. If you are not the bill payer for the device, we assume you have obtained the bill payer's permission.

Device Responsibility

You are responsible for keeping your device charged and in a working condition. Hakiware is not liable for your inability to access the Service due to device failure, insufficient battery, or any other device-side condition outside our control.

Third-Party Services

Our Services may contain links to, or integrate with, third-party websites or services. These are governed by their own terms and privacy policies, and Hakiware has no responsibility or liability for their content or practices. We encourage you to review the terms of any third-party service you use.

Where a third-party provider processes personal data on our behalf in order to operate the Service, that processing remains subject to the safeguards and disclosures described in our Privacy Policy.

Limitation of Liability

While Hakiware strives to keep the Services accurate and up to date, some information depends on third parties. To the maximum extent permitted by applicable law:

• Hakiware accepts no liability for direct or indirect losses arising from sole reliance on the Service.
• Hakiware assumes no responsibility for aspects of the Service that depend on Internet availability, third-party data, or device conditions outside its control.
• Where our Services facilitate transactions or work between end users and professionals, those professionals remain solely responsible for the quality, safety, legality, and fulfilment of their services.

Updates & Availability

Hakiware may release updates to the Services from time to time. Operating system requirements may evolve, and you may need to install updates to continue using a Service. Hakiware does not guarantee that a Service will always remain compatible with your device's OS version.

By accepting these Terms you agree to install updates when offered. Hakiware may also suspend or discontinue a Service at any time without prior notice.

Termination

Hakiware may terminate or suspend your access to any Service at any time and for any reason, including but not limited to a breach of these Terms, without prior notice.

Upon termination:

• All rights and licences granted to you under these Terms cease immediately.
• You must stop using the Service and, where applicable, delete it from your devices.
• Provisions that by their nature should survive termination — including intellectual property rights, limitation of liability, and governing law — will continue to apply.

Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated effective date. We encourage you to review this page regularly. Continued use of any Service after changes are posted constitutes your acceptance of the updated Terms.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or your use of the Services shall be submitted to the exclusive jurisdiction of the competent courts of Morocco.

Mention légale CNDP (Maroc — Loi 09-08)

Hakiware, studio logiciel indépendant immatriculé au Maroc sous l'ICE 003673187000049, collecte et traite vos données à caractère personnel en vue d'assurer la gestion des utilisateurs, la mise en relation entre clients et techniciens/artisans, la messagerie liée au service, ainsi que la sécurité et l'amélioration de ses plateformes.

Ce traitement est soumis aux formalités prévues par la loi marocaine n° 09-08 et a été autorisé (ou est en cours d'autorisation) par la CNDP sous le numéro [en cours d'autorisation].

Dans le cadre de l'hébergement et du stockage technique des données, celles-ci peuvent faire l'objet d'un transfert à l'étranger vers l'Allemagne, notamment auprès de l'hébergeur Hetzner Online GmbH. Ce transfert est soumis aux formalités applicables auprès de la CNDP sous le numéro [en cours d'autorisation transfert].

Conformément à la loi n° 09-08, vous disposez d'un droit d'accès, de rectification et d'opposition au traitement de vos données personnelles. Vous pouvez exercer ces droits en adressant votre demande à contact@hakiware.com.
